How mid-term rental management works in Atlanta
The 30-day line is the entire strategy
Atlanta’s short-term rental ordinance (20-O-1656) has been enforced since 5 March 2023. It defines a short-term rental as lodging for a period of time not to exceed 30 consecutive days, and it caps a single licence at the holder’s primary residence plus one additional dwelling unit.
Read that definition carefully, because the opportunity is inside it. A furnished let of 30 or more consecutive days is not a short-term rental under the ordinance. It does not need a short-term rental licence, and it is not counted against the two-dwelling cap. For an owner who has already spent their licence on a primary residence and one rental, mid-term is the compliant way to put a third, fourth, or fifth property to work.
What mid-term actually earns — the honest version
A well-run short-term rental in a strong Atlanta submarket will almost always gross more than the same home let on 30-day terms. Anyone selling mid-term to you as a pure revenue upgrade is not being straight with you, and we would rather lose the conversation than start it with a lie.
The trade is real, though, and for a lot of owners it is the better one. Fewer turnovers means dramatically lower cleaning and linen cost, fewer consumables, less wear on the soft furnishings, and fewer of the small breakages that eat a nightly calendar. It means less regulatory exposure, because you are outside the licence regime entirely. It means steadier occupancy, because one 90-day booking does not care whether it rained in February. And it means the phone rings at 2am a great deal less often.
What mid-term rental management looks like in Atlanta specifically
Atlanta is the one city here where the 30-day line is written into a code section you can pull up yourself. Section 20-1003 of the land development code defines a short-term rental as "an accommodation where, in exchange for compensation, a residential dwelling unit is provided for lodging for a period of time not to exceed 30 consecutive days." Read the words closely, because they set the drafting standard: the definition tops out at 30. We therefore write Atlanta mid-term agreements at 31 consecutive days or longer rather than at exactly 30. The extra night costs nothing and puts the stay unambiguously outside the definition.
That extra night lines up with the tax boundary, which is where Atlanta owners most often get caught. Georgia’s state hotel-motel fee is $5.00 per night, and the Department of Revenue is specific that on the 31st day of uninterrupted continuous occupancy the fee is no longer collected. Local hotel-motel excise tax follows a different rule again: O.C.G.A. 48-13-51 exempts only charges for continuous use of an accommodation after the first 30 days of continuous occupancy. So the first thirty nights are still taxed, here as everywhere in Georgia. We remit on that basis and watch House Bill 492, which would repeal that local exemption outright.
One more Atlanta-specific trap: the ordinance follows the city limits, not the postmark. Thousands of addresses that read "Atlanta, GA" actually sit in Sandy Springs, Brookhaven, Chamblee or unincorporated DeKalb, each of which writes its own rules. Do I need a special license to rent my Atlanta home on Airbnb?
Yes. The City of Atlanta requires a Short-Term Rental License (STRL) issued through atl311.com, currently $150 per year. You may hold a maximum of two STRLs, and at least one property must be your primary residence. Your license number must appear on your listing. If your home is in unincorporated DeKalb County, a separate DeKalb STR license ($175/year) is required as of May 2026. ATLStay walks every new client through the compliance process.
